Tier 2: Financial Viability
We then assess the financial profile of the claim. This includes expected costs, likely damages,

Tier 3: Insurability and Recoverability
Finally, we consider how the case can be insured and enforced. We review After the Event (ATE)
insurance options and examine the defendant’s financial standing. If a claim can’t be insured or
enforced, even if it’s legally sound, we won’t proceed.
